UHC - Small Business Rate Action Effective 11-1-10

Health Care costs continue to grow faster than the general economy for a variety of reasons, including factors such as increased hospital and physician costs, the increase of chronic disease, and the lack of consumer engagement to help make better more informed health care decisions.  UnitedHealthcare is committed to doing their part of managing overall health care costs.  They remain an active steward in the decision-making that directly impacts the health care system and they continue to provide the information, guidance and tools to help their members make good decisions about their health and well-being, as well as their care.
 
The average statewide rates for new business will increase by approximately 2% for HMO and 3% for PPO/HSA.  Specific Northern California areas and averages are as follows:
 
Fresno:
 
* Effective 11-1-10:  3% for HMO; 2% for PPO/HSA
* The annual trend increase for PPO/HSA is 5.1%
 
San Francisco (Bay Area):
 
* Effective 11-1-10:  3% for HMO and 1.5% for PPO/HSA
* The annual trend increase for HMO is 7.8%
* The average trend increase for PPO/HSA is 11.2%
 
The average statewide rate increase for renewing customers is approximately 11% for HMO and 13% for PPO.  UHC continues to offer an array of plan designs and funding approaches so you can present the best alternatives that suit your client's financial and coverage needs.  Refer to the attached Small Business 2-50 Product Catalog for more details
 
UHC will continue to implement the provisions of the Patient Protection and Affordable Care Act (PPACA) for plan years beginning on or after September 23, 2010.

Discriminatory Insured Medical Plans

As stated in Section 2716 of the Patient Protection and Affordable Care Act (PPACA), effective for plan years beginning on or after September 23, 2010, the nondiscrimination rules of IRC Section 105(h) will now apply to fully insured medical non-grandfathered plans.
 
Self-funded medical plans are already subject to these requirements.  In a self-funded plan, highly compensated individuals who receive discriminatory benefits are subject to taxes on the value of the benefits.
 
For purposes of PPACA, a discriminatory insured medical plan is defined as one that fails to satisfy the requirements of section 105(h)(2) relating to discrimination in favor of highly compensated individuals.  These plans are sometimes also known as "carve-outs."
 
Policyholders are encouraged to contact their tax counsel or accountant, because if the coverage they provide does discriminate in favor of highly compensated individuals, they may have to pay substantial penalties.


Aetna Small Group - Changes to 1099 Coverage

Aetna Small Group has made a change to their policy related to coverage for 1099 employees.
 
Effective with October 1, 2010 new business, Aetna will no longer be offering coverage to 1099 employees through a small group employer policy.
 
For existing Aetna Small Group business:
  • If an employer group is currently insuring 1099 employees, Aetna will continue coverage under the employer policy.  This would apply to current 1099 employees as well as future 1099 employees as they become eligible for benefits
  • If the employer group does not cover 1099 employees, Aetna will not allow them to be added
